These terms and conditions govern access to and the use of the services on the website www.dooplan.com (hereinafter referred to as “dooplan”), which Organic makes available on the site to Internet users who may be interested in its services and content. The purpose of dooplan is to suggest the most interesting plans as well as people to share them with

Organic reserves the right to change the design, presentation and/or configuration of dooplan and/or any or all of its services at any time and without prior warning

Use of dooplan implies the users’ full acceptance of the terms and conditions published by Organic. Organic also informs the users of dooplan that these terms and conditions are subject to change at any time without prior warning. Users must therefore read these terms and conditions carefully each and every time they intend to use the website’s services, bearing in mind that terms and conditions may have changed.

Use of certain services offered to users on the dooplan website may be subject to specific terms and conditions, which, when applicable, may complement and/or complement these general terms and conditions of use. Users should read any service-specific terms and conditions carefully and accept them before using such services.

2. Conditions for accessing and using dooplan Users shall make appropriate use of the content and services available on dooplan. Said use shall be fully subject to the appropriate legislation, standard accepted practice, these general terms and conditions and, where applicable, any service-specific terms and conditions. Users shall also treat other users with due and proper respect

Uses other than dooplan’s expressly defined purpose are expressly prohibited

In this respect, the users undertake to refrain from using any of the material and information available on dooplan for unlawful purposes, for purposes that are expressly prohibited in these general terms and conditions or any service-specific conditions that may apply, or for any purposes that are contrary to the rights and interests of Organic, its members and/or third parties. The users shall be liable to said parties if, for any reason, they contravene or fail to comply with these obligations and/or, in any way (including by introducing or spreading computer viruses), damage, render unusable, overload, impair or otherwise prevent the normal use of the material and information available on the website, the information systems or documents, files and all manner of content stored on any piece of electronic equipment (hacking) belonging to Organic, its members or any dooplan user

In order to use the services offered by Organic, users must fill out a user identification form and select a user ID/login and password, which they agree to use and diligently safeguard

Organic will assign the user his or her selected user ID, provided that it has not already been selected by another user. User passwords are personal and non-transferable and may not be given to others, even for temporary use. Users must therefore take necessary measures to maintain the confidentiality of their passwords and prevent them from being used by others. The user is solely responsible for any use of his or her password, and Organic cannot be held liable for such use. In the event that a user is aware or suspects that his or her password is being used by third parties, he or she should notify Organic as soon as possible

The aforementioned registration shall be carried out in the manner indicated in the service itself or in the service-specific terms and conditions that govern it, as the case may be

All information provided by the user via the website’s services must be truthful. To this end, the user guarantees the authenticity of all data provided when filling out the forms required to sign up for the services

Similarly, the user shall be responsible for keeping all information provided to Organic up to date, so that at any given time, it accurately represents his or her current situation. In any case, the user shall be the only person liable for any false or inaccurate statements made and for any damages that Organic or third parties may suffer as a result of the information provided

In compliance with Organic’s anti-spam policy, the users undertake to refrain from using or gathering data from any distribution lists that may be accessed through information or services contained on the website for promotional or advertising purposes or from sending unsolicited commercial correspondence of any kind via any medium without the prior consent of Organic and/or the affected parties

Users who intentionally or negligently fail to comply with the foregoing obligations shall be liable for any damages they may cause 3. Obligations regarding the use of dooplan 3.1. General obligations regarding the use of dooplanThe information provided by users in the registration process and in all other services must be true and accurate. The information provided must be legally valid and meet the requirements and conditions of dooplan

Organic does not allow users to use dooplan services in ways that could hinder the quality of the service. The following actions are prohibited

• Actions that are illegal under national, EU or international law or activities or performing actions that are illegal or contravene the principles of good faith.
• Actions containing allegedly criminal information, such as libel, threats, injuries or any other crime specified in the criminal code.
• Actions that do not comply with Organic’s quality standards.
• Actions that are in violation of basic individual rights, seek out users’ weaknesses, demonstrate a lack of online courtesy or disturb or generate negative opinions among dooplan users or third parties, including but not limited to any of the legal rights of third parties; content that favors or encourages the creation, maintenance and promotion of businesses related to pornography, obscene material or erotic listings or any other related content; and, in general, any content that Organic feels is inappropriate for users and/or minors.
• And, in general, actions that breach the principles of legality, honor, responsibility, protection of human dignity, protection of minors, protection of public order, protection of private life, protection of the consumer and the protection of intellectual and industrial property rights.

3.2. Photo publication policyThe purpose of a dooplan user’s main photograph is to help identify and distinguish him or her from other users.

Organic will not allow its members to use any type of image, meaning that it will only publish images that have been accepted after a validation process conducted according to the exclusive criteria of the staff at Organic

A photograph may be rejected for a number of reasons:

• Because it does not comply with the dooplan philosophy. Organic will not allow photographs with offensive, violent, ideological, xenophobic, obscene and/or sexual content.
• Due to security or data privacy concerns. Organic will not allow photographs or images that contain information such as names, telephone numbers, e-mail addresses or URLs.
• Because it is difficult to view or the quality is low.
• Because it was not loaded onto the site correctly.

Organic cannot confirm copyrights over the images included on its user profiles. If they are shown to a third party, they should come with express authorization, and sole liability shall belong to the user involved.

Organic reserves the right to crop – but never to otherwise alter – the images in order to adapt them to the photo publication policy described herein. Furthermore, Organic reserves the right to eliminate without prior warning any images that it deems inappropriate given the purpose and nature of the site

Users may not publish copyrighted photographs or materials. Organic cannot be held liable for the photographs published by users on its website.

All photographs on dooplan are subject to subsequent revision and deletion.

Please let us know if you find a photo on dooplan that does not comply with this policy.3.3. Profile approval policyThis profile approval policy is designed to regulate the content of the profiles in order to guarantee the overall quality of the site, including content, language and intention that are appropriate for all users.

Organic will not approve profiles containing:

• Sexually explicit language or sexual references.
• Libelous, abusive, aggressive or violent content.
• Offensive or obscene language (including coarse language).
• Blasphemous or racially offensive terminology.
• Nude or sexually suggestive photographs.

Organic reserves the sole right of discretion to reject users if, in its opinion, the information published does not guarantee a level of trust, security and credit that is sufficient for inclusion in the Organic community of users.

In this respect, Organic reserves the right to eliminate registered users who do not meet its quality and accuracy requirements without prior warning

Organic cannot monitor all of the content published on its website, and as such, it cannot be held responsible for the content. Nevertheless, the company does carry out periodic checks to ensure that its quality principles and the standards described herein are upheld

These terms and conditions may be changed at any time without prior warning 4. Dissemination of user content The user expressly authorizes Organic to disseminate his or her profile on dooplan and any other forms of communication used on dooplan

The user expressly authorizes Organic to modify some content in order to respect the website’s graphic design or any other forms of communication used on Organic’s Web platform. The user grants these usage rights or license for all countries and for the duration of the legal protection over the user’s own rights 5. Exemption from guarantees and liabilit Excepting the specific situations described in the general terms and conditions of use and dooplan’s prevailing legal framework, Organic shall not be liable for damages of any kind caused by inaccurate, incomplete or out-of-date information or due to errors or omissions in the information and services on dooplan or other content that is accessible via the site, nor does it assume any duty or commitment to verify or safeguard such content and/or information

Moreover, Organic does not guarantee the ongoing availability or operability of dooplan, and as a result, it is exempt, as far as permitted under current legislation, for damages of any kind that may be caused by the non-availability or non-continuity of dooplan and the services provided on the site and for errors in accessing different websites or the websites that provide said services, as the case may be

All information and materials available on dooplan, including information and materials made available by users, advertisers, organizations and others, including but not limited to opinions, comments, advertising, recommendations, evaluations and images, exclusively represent the point of view their authors and are subject to their authors’ liability. In no way do such materials or information constitute a point of view, opinion or acceptance by dooplan

dooplan does not compensate individuals or institutions for complaints, actions, statements or otherwise that originate from them or are related to the opinions of the users

The users accept that such information is a risk associated with their account and that dooplan shall not be liable for such information

The users shall accept liability for any and all damages that Organic or dooplan may suffer, directly or indirectly, due to their failure to comply with any of the obligations derived from the general or service-specific terms and conditions related to the use of the Web portal and/or any of the related services 7. Applicable legislation and jurisdiction These general terms and conditions and any other legal terms and conditions contained on the website are governed by Spanish law.

For any issues that may arise or any legal action that may be exercised in relation with the services and content provided dooplan and for any issues regarding the interpretation, application, compliance and/or non-compliances with the provisions contained herein, the Organic and the user expressly renounce any other jurisdiction that may correspond to them and subject themselves to the jurisdiction of the courts and tribunals of Barcelona.
